What Employers Are Capable Of Doing (Final Report).

A Meeting between my ex-colleague and his former employer was held early this week at the Labour Department.

The employer's representative informed the officer that the company was prepared to settle the employee's outstanding salary, claims and allowance by this month. With regards to the outstanding Bonus for the year 2006 and 2007, the employer is prepared to pay the employee his 2006 Bonus in full. As for 2007, they proposed to pay half of what was stated in the first EA. And, proposed to settle the total outstanding Bonus payment in six monthly payments citing that he have been taking 'no-pay-leave' very often and also due to the company's financial difficulties.

(With regards to the 2007 Bonus issue, after the first Meeting at the Labour Department; the employee was issued a new 'EA'. In that new 'EA', the issue of Bonus was totally ommited. The amount declared by the employer as the total annual income in 2007 for my ex-colleague, was a difference which was almost double that of his Bonus. Obviously, a mistake was made by the employer).

My ex-colleague made a counter proposal. He is ready to compromise just to help the company out, but, insisted that the Bonus for 2007 be revised and put forward his proposal. The condition was that he will only accept if his Bonus for 2006 and 2007 is settled in three equal monthly payments. Otherwise, he will place the matter with the Labour Court. The employer's representative have no authority to make a decision on behalf of the company. As this is the final meeting to resolve matters amicably, he was told point blank that he cannot bid for more time. So, he reluctantly called his boss and at last, he obtained an agreement to meet with the demands of David, my ex-colleague.  

David could not contain his joy for slaying Goliath once hw was outside the Labour Department. He called to say that he was extremely happy that justice was done and firmly believe that his case will certainly serve as an inspiration to the majority of the other employees who are suffering silently in great pain.

  1. The Big boys will try to get away with whatever they can, and they do because most people just want to get on with their lives and dont want to bother.....but they back up quickly if they get called to task by the regulatory people.....in otherwards......*bullies*.....lol....riff

  2. congratulation to david. He has just won the initial battle. The full battle would be getting the full payment that is in three months time. Hopefully it will be positive. Lesson to learn from this case is to know your strength and the situation that you are facing in this case the employer. It reminds me of the quote from sun tzu ...know your self and know your enemy then the battle is won. Wow not only sun tzu art of war can be used for business but others too...

  3. Hi KA, Great to hear from you man! David is a hero to the 'silent majority' now. He have another colleague in the same office who had resigned at the same time with him. But, that guy have got nothing yet. I mean the balance of his bonus and claims. He is contemplating whether he should do likewise. He is a little reluctant to take action.....'God help those who help themselves'says David. Best Wishes.
